This Privacy Policy applies to Life Agents, LLC ("Nomi," "We," "Us," or "Our") and describes our policies with respect to the collection, use, disclosure, and protection of information we collect through our websites, including https://nomifriend.com ("Websites" or "Sites"), Nomi mobile applications ("Mobile Apps"), and other products or services owned or operated by Nomi ("Services"). Nomi is committed to protecting the confidentiality and security of information it collects through its Services.

Please read the following carefully. Your use of our Services is governed by this Privacy Policy and Nomi's Terms of Service (available at: https://nomifriend.com/terms). Our Privacy Policy and Terms of Service do not apply to any third-party websites, services, or applications, even if they are accessible through our Services.

By using our Services, you are accepting the practices described in this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Services.

• Revisions to this Privacy Policy. Any information that is collected via our Services is covered by the Privacy Policy in effect at the time such information is collected. We may revise this Privacy Policy from time to time. If we make any material changes to this Privacy Policy, we'll notify you of these changes as required by applicable law — for example by posting them on the Services or providing email or other notice — and we'll update the "Last Updated" date at the top of the Privacy Policy to indicate when those changes will become effective. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you continue to use the Services after the updated Privacy Policy is posted.

1. Information We Collect

We collect information in three main ways: (1) information we collect automatically through technology when you use the Services; (2) information you provide directly to us; and (3) information we collect from other sources.

Automatically Collected Information

Device and Usage Information. We may collect information about the devices you use to access our Services, such as IP address, device ID, cookie ID, user settings and preferences, operating system, the content you interact with on our Sites, app version, and other information permitted by Android or iOS based on their policies and your settings.

Location Information. We may collect general location information about your device based on your IP address, or that you volunteer or enable through the Mobile App or your device settings. We do not retain precise geolocation data.

Conversation and Interaction Data. When you use AI companion features within our Services, we collect the messages, inputs, and content you submit during conversations. This data is used to provide and improve the Services, personalize your experience, and power the memory and personalization features described in this Policy.

Information You Provide to Us

Account Information. If you register for an account, we may collect your name or display name, email address, password, and other registration information such as your birth year. You may also register using credentials from social media platforms such as Facebook, Google, or Apple ("Social Networks"), which may share your account name, email address, profile image, or other information based on their policies and your settings.

Profile and Preference Information. You may provide us with preferences such as the types of companion characters you are interested in, topics you enjoy discussing, and other personalization information that helps us improve your experience.

Subscription and Payment Information. If you subscribe to a paid tier of our Services, payment processing is handled by third-party providers. We do not store full payment card numbers; we may retain limited billing information such as your subscription status, plan type, and transaction history.

Other Information You Voluntarily Provide. We may collect any other information you choose to share with us, such as feedback, support requests, and contact information.

Information Obtained from Third Parties

We may receive information about you from other sources, such as social network services, business partners, analytics providers, and advertising platforms, and combine this information with other information we have about you.

2. AI-Generated Companions and Conversation Memory

Nomi provides AI-powered companion characters that engage in personalized conversations with you. To deliver this experience:

Memory and Personalization. We may retain facts, preferences, and context extracted from your conversations (such as your name, interests, and topics you have discussed) to personalize future interactions. This information is stored and used to make the AI companion experience feel more continuous and personal over time.

AI Model Providers. Conversation content may be processed by third-party AI model providers (such as OpenAI or similar services) to generate responses. We take reasonable steps to limit the personal data shared with these providers, and such sharing is governed by our agreements with those providers.

Proactive Messaging. As part of our Services, AI companion characters may send you push notifications or in-app messages to re-engage with you after periods of inactivity. These messages are AI-generated based on the companion character's persona and your prior interaction history.

3. Cookies, SDKs, and Similar Technologies

We and our vendors use cookies and similar technologies to collect Device and Usage Information from visitors to our Sites in order to remember you and your preferences, better understand how you use our Services, optimize and serve relevant advertisements, and perform research and analytics. We may also use Software Development Kits (SDKs) to allow our advertising and analytics partners to collect device and usage information. We do not currently recognize "do-not-track" signals from web browsers.

4. How We Use Your Information

We may use your information in one or more of the following ways:

Provide, Develop, and Improve the Services:

Delivering and operating the Services, including AI companion conversations and personalized experiences
Powering memory and personalization features within the Services
Improving the quality, safety, and relevance of AI-generated content
Communicating with you about your account, technical support, and changes to our policies
Sending push notifications, including AI-initiated companion messages, subject to your notification preferences

Advertising and Marketing:

Personalizing content and advertisements on our Services and on third-party platforms
Marketing to you regarding features or offers we believe may interest you
Measuring and analyzing the effectiveness of advertising campaigns

Internal Research and Development; Quality Control:

Aggregating and analyzing activity to evaluate and improve existing Services
Performing statistical and demographic analyses of user behavior
Troubleshooting, debugging, and optimizing our Services and operations
Monitoring safety and quality of AI-generated content

Security, Protection, and Legal Compliance:

Securing the Services and detecting, investigating, and preventing fraudulent, harmful, or illegal activity
Ensuring compliance with our legal obligations and responding to valid legal process
Verifying your identity or that of your authorized agent

We may combine information collected through the Services with information collected automatically or received from other sources, and use such combined information in accordance with this Policy. We may also aggregate and/or de-identify information in such a way that it cannot reasonably be linked to you or your device, and use or disclose such data for any purpose.

5. How We Disclose Your Information

To AI Model Providers. As described above, conversation content may be shared with third-party AI model providers to generate responses. This data sharing is subject to appropriate data processing agreements.

To Advertising and Marketing Partners. We may allow third-party advertising and marketing partners to deliver relevant advertising to you on our Services and on other platforms. We may provide your online activity or device-related information to our marketing partners for this purpose.

To Affiliates and Service Providers. We may disclose information to our affiliates or service providers who process it subject to obligations consistent with this Privacy Policy.

To Legal and Government Entities. We may share information with governmental authorities or law enforcement officials to respond to a lawful request or process, including a court order or subpoena, or to meet national security or law enforcement requirements.

In Connection with Business Transfers. We may disclose your information in connection with a substantial corporate transaction, such as a merger, acquisition, asset sale, or bankruptcy.

With Your Consent. We may share information with third parties with your consent.

6. Your Rights and Choices

Depending on where you reside, you may have rights with respect to your information as outlined below.

Rights for Users in Certain States. Various states have privacy laws that provide residents with certain rights, which may include the right to:

Confirm whether we are processing your personal information
Access or obtain a copy of your personal information
Correct or update personal information we hold about you
Delete certain personal information we have about you
Opt out of the processing of your personal information for targeted advertising or profiling purposes

To exercise any of these rights, please email us at privacy@nomifriend.com with the subject line "Privacy Law Request." To protect your information, we may need to verify your identity before processing your request. Residents of certain states, including Colorado, Connecticut, Oregon, Texas, and Virginia, have the right to appeal our decision to deny a request.

Data Deletion. You can delete your personal data by deleting your account through the app's settings. If you need assistance, contact us at privacy@nomifriend.com.

Push Notifications. You may opt out of push notifications at any time by changing the notification settings on your mobile device. Note that opting out of push notifications will also disable AI companion-initiated messages.

Email Communications. If you receive promotional emails from us, you may opt out by following the unsubscribe instructions in those emails. You will continue to receive administrative messages even after opting out of marketing communications.

Opt Out of Ad Tracking. You may opt out of certain targeted advertising by visiting http://optout.aboutads.info or http://optout.networkadvertising.org on each of your devices and browsers. Your browser or mobile device may also include settings to manage ad tracking, such as "Limit Ad Tracking" on iOS or "Opt out of Ads Personalization" on Android.

7. Sensitive Personal Information

By nature of being an AI companion application, you may choose to share sensitive or personal information during conversations, including information about your health, relationships, finances, or other private matters. We treat this information with care and use it only as described in this Privacy Policy. We encourage you to exercise discretion in the information you share; we are not responsible for any information you voluntarily provide during conversations.

8. Links to Other Sites

Our Services may contain links to websites, features, or services owned or operated by third parties. We do not control those websites and are not responsible for their content or privacy practices. We encourage you to review their privacy policies before providing them with information.

9. International Users

Nomi is located in the United States and processes your data in the United States. We may also subcontract the processing of your data to, or otherwise share your data with, service providers in countries other than your country of residence, in accordance with applicable law. By providing us with your information, you acknowledge any such transfer, storage, or use.

10. Children's Privacy

Our Services are intended for users who are 17 years of age or older. We do not knowingly collect personal information from individuals under the age of 17. If you believe a minor has provided us with personal information, please contact us at privacy@nomifriend.com. If we become aware that we have collected personal information from a user under 17, we will take steps to delete such information.

11. Security

We use a variety of administrative, technical, and physical security measures to protect your information from unauthorized access, loss, alteration, use, or disclosure. Please be aware, however, that no method of transmitting or storing information is completely secure. Accordingly, we cannot guarantee the absolute security of any information.

12. Data Retention

We retain your information for as long as necessary to provide our Services and for other necessary legal purposes, including complying with legal obligations, resolving disputes, enforcing our agreements, and fraud prevention. In determining how long to retain information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process the information, and applicable legal requirements.

Conversation and memory data may be retained to power the personalization features described in this Policy. You may request deletion of your data by deleting your account or contacting us at privacy@nomifriend.com.

13. Notice to California Residents

This section provides additional information for California residents.

California "Shine the Light" Rights. California residents may request once per year the names and addresses of affiliated companies to whom we have disclosed their personal information for direct marketing purposes, as well as the categories of personal information disclosed. We do not share your personal information with third parties for their own direct marketing purposes.

California Consumer Privacy Act (CCPA / CPRA)

We collect the following categories of personal information from California consumers: Identifiers; internet or other electronic network activity information; commercial information (subscription status); inferences drawn from your information to create a profile; and the content of messages and AI conversations.

California residents have the following rights:

The right to know the categories and specific pieces of personal information we have collected about them
The right to access their personal information
The right to deletion of their personal information
The right to correct inaccurate personal information
The right to opt out of the sale or sharing of personal information for cross-context behavioral advertising

To exercise these rights, email privacy@nomifriend.com with the subject "Privacy Law Request." We will verify your identity before processing your request and will not discriminate against you for exercising your rights.

Notice of Right to Opt Out of Sale/Sharing. We may disclose your information to third-party advertising partners through tracking technologies, which may constitute a "sale" or "sharing" of personal information under the CCPA. To opt out, navigate to the "Privacy Settings" section in the Mobile App. We do not knowingly sell the personal information of minors under 16.
